1 Information on how to enter and prizes form part of the conditions of entry. Entry into the Promotion is deemed acceptance of these terms and conditions.
2 The Promoter is ASTRA (Australian Subscription Television and Radio Association), 55 Pyrmont Bridge Road, Pyrmont, NSW 2009. ABN: 18 851 051 883
3 Entry is open to all Australian residents who are members of households who receive FOXTEL, AUSTAR or OPTUS Pay TV at the time of entry and continue to remain customers at the date of the prize draw. Management and employees (and their immediate families) of the Promoter, agencies and other companies associated with this Promotion are not eligible to enter. Any person who receives subscription television service through any pirate service or device is also not eligible to enter the prize draw. If the AUSTAR, FOXTEL, or OPTUS Pay TV account in the household has amounts outstanding then members of these households are also not eligible to enter the prize draw.
4 The Promotion commences on Wednesday 26 March 2008 at 14:00 (AEST) and concludes at 23:59 (AEST) on Wednesday 16 April 2008. (Promotional Period)
5 For all residents (except AUSTAR subscribers and SA residents): To enter and be eligible to win, entrants may enter in either of the following ways:
(a) Participants must use the interactive ASTRA Awards Voting application located on Channel 222 of OPTUS Digital, FOXTEL Digital and AUSTAR Digital platforms during the promotion period.
(i) If a participant’s set top box has a Return Path which permits information to be sent from the participant to the operator, then the participant will be able to submit their name, contact number and votes for each of the (5) Awards categories in order to gain a valid entry into the competition. The cost of entering the vote will be the cost of a local call.
(ii) If a participant’s set top box does not have a Return Path or if voting information is not able to be received from the Return Path the interactive ASTRA Awards Voting application will generate an alphanumeric voting code specific to the participant’s voting preference. This should then be sent via SMS to 1999 8877 in order to gain a valid entry into the competition. The cost of entering the vote will be $0.55.
(b) Participants must log onto www.astraawards.com during the promotion period and register their vote for all (5) categories open to public voting. Details to be entered include but are not limited to name, address, phone and e-mail address.
6 For AUSTAR subscribers and SA residents: To enter and be eligible to win, entrants may enter in either of the following ways:
(a) Participants must use the interactive ASTRA Awards Voting application located on Channel 222 of OPTUS Digital, FOXTEL Digital and AUSTAR Digital platforms during the promotion period.
(i) The interactive ASTRA Awards Voting application will generate an alphanumeric voting code specific to the participant’s voting preference. This should then be sent via SMS to 1999 8877 in order to gain a valid entry into the competition. The cost of entering the vote will be $0.55.
(b) Participants must log onto www.astraawards.com during the promotion period and register their vote for all (5) categories open to public voting. Details to be entered include but are not limited to name, address, phone and e-mail address.
SMS messages must be sent from a mobile phone handset that can be identified by an MSISDN (unique mobile SIM number) to be eligible. The SMS entry mechanic is only open to consumers with a SMS compatible mobile phone connected to a service provider which permits text messaging to the promotional SMS number. It is recommended that entrants check with their individual service provider in this regard. Messages sent from the internet or similar online systems will not be accepted. SMS costs are charged at $0.55 including GST.
8 A valid vote will be determined through the provision of a legitimate subscription (for Interactive Voting) and legitimate mobile phone number (for SMS Voting) and a legitimate email address (for web voting). Each vote will entitle the participant to one entry into the prize draw. Participation is limited to one vote per legitimate mobile phone number or legitimate email address and five votes per set top box permitting information to be sent from the participant to the operator via a Return Path.
9 The major prize draw will take place at 11:00 (AEST) on Thursday 17 April 2008 from all eligible entries received at belong Pty Ltd, Level 8, 155 George Street, Sydney NSW 2000. The winners will be notified by telephone and in writing (via SMS) and by mail. The results will be published in the public notices section of the Australian on Monday 21 April 2008.
10 There are two major prizes on offer. The first major prize will be awarded to the first valid entry drawn from all eligible entries. If the major winner is under the age of 18 years they must travel with their parent or guardian. The second major prize will be awarded to the second valid entry drawn from all eligible entries.
11 The first valid entry drawn from all eligible entries will win two tickets to attend the ASTRA Awards held in Sydney on Monday 21 April 2008. The prize includes the tickets, return economy airfares from the winner’s nearest capital city, 1 night’s accommodation in a minimum 3 star hotel in Sydney. Additional spending money, meals, travel to and from departure point, transfers, travel insurance and all other ancillary costs (including travel to and from the event) are the responsibility of the winner and his/her guest. Incidental charges charged to the winner’s room, such as meals, mini bar, laundry room services, telephone calls etc, are also at the expense of the winner. The major prize is valued at a maximum of $3,500 depending on the point of departure.
12 The second valid entry drawn from all eligible entries will receive a Philips 42” Flat TV with Pixel Plus 2 HD [Model No: 42PFL7532D/79] valued at $1,999.95 (RRP including GST).
13 Total prize value is $5,499.95 (including GST)
14 The major prize is for the specified dates of the event only. If the winner resides in SA, the winner can transfer all components of the major prize and may nominate someone else to travel in his/her place if they are unable to accept the prize. If the winner (for whatever reason) is unable to travel or does not take an element of the major prize within the time stipulated by the Promoter, and, where the winner is from SA and is unable to nominate someone else to travel in his/her place, then the prize will be forfeited and an alternate prize of similar monetary value will be awarded.
15 The major prize must be claimed by 9:00 (AEST) on Friday 18 April 2008 (for all states except SA and VIC) and if the major prize remains unallocated or unclaimed, a further draw will be conducted on Friday 18 April 2008 at 9:30 (AEST) at the same place as the original draw (subject to any written directions given under all State Regulation). In the event of a re-drawn winner, the winner will be notified by telephone and mail their details will be published in the public notices section of The Australian on Monday 21 April 2008.
16 Should the original winner be from VIC, the major prize must be claimed by 15:00 (AEST) on Friday 18 April 2008 and if the major prize remains unallocated or unclaimed, a further draw will be conducted on Friday 18 April 2008 at 15:30 (AEST) at the same place as the original draw (subject to any written directions given under all State Regulation). In the event of a redrawn winner, the winner will be notified by telephone and mail their details will be published in the public notices section of The Australian on Tuesday 22 April 2008.
17 Should the original winner be from SA and the Promoter is unable to contact them before 9:00 (AEST) Friday 18 April 2008, the original prize will be forfeited. An unclaimed prize draw will take place on Monday 18 August 2008 at the same time and place as the original draw subject to all applicable State Regulation including Regulation 37 of the Lotteries and Gaming Act 1993 (SA) at which time the Promoter will offer a similar prize or cash in lieu of the major prize. In the event of a winner, their details will be published in the public notices section of The Australian on Monday 25 August 2008.
18 Only one prize per household is permitted (except for SA residents). The winners will be deemed as the entrant identified in the original entry (as long as they are a valid subscriber). That is, the name and contact details entered (whether via Channel 222, online or SMS) and winner notification will be sent to the e-mail address/mailing address supplied.
19 Incomplete and unintelligible entries are not eligible to win. Entries will be deemed to be accepted at the time of receipt and not at the time of transmission. The Promoter accepts no responsibility for delayed entries and entries not received for any reason during the Promotional Period.
20 The prizes are not transferable (except subject to clause 13), divisible or exchangeable and cannot be redeemed for cash. The Promoter accepts no responsibility for any variation in the value or content of the prizes. If the Promoter is unable to provide any winner with the nominated prize, the Promoter reserves the right to supply an alternative prize of similar monetary value subject to State Regulation. The prizes are subject to the terms and conditions of the prize supplying companies. The Promoter and their associated agencies, and companies associated with this promotion will take no responsibility for prizes damaged or lost in transit.
21 The judge's decision is final and no correspondence will be entered into.
22 The Promoter, in its absolute discretion, reserves the right to verify the validity of all entries and to disqualify any entrant who tampers with the entry process, including but not limited to, techniques designed to avoid payment of call costs, or who submits an entry that is not in accordance with these Conditions of Entry.
23 The promoter reserves the right to refuse to allow the winner to take part in any or all aspects of the prize, if the Promoter determines, in their absolute discretion, that the winner is not in the mental or physical condition necessary to be able to safely participate in the prize. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.
24 The Promoter will not be held liable for any loss, damage or injury which may result directly or indirectly from this Promotion, except that which cannot be excluded by law.
25 All entries become the property of the Promoter. The Promoter collects personal information about you to enable you to participate in this promotion and for communicating information about the ASTRA Awards and its sponsors but no further use of this information will be made without prior permission from the entrant. To facilitate your participation, the Promoter may disclose your personal information to other companies associated with this promotion and to verify that entrant’s households are subscribers to either FOXTEL, AUSTAR or OPTUS Pay TV. If you do not provide your personal information, the Promoter will not be able to enter you into this promotion.
26 If for any for any reason this promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this promotion, the promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process.
27 In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders it's determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; the Promoter may in its absolute discretion cancel the event and recommence it from the start on the same conditions subject to State Regulation.
